ADMINISTRATION FEE CHARGING POLICIES
(a) The Fee Schedules are subject to change without prior notice. Lextar Arbitration Services reserves the right to make changes to the Fee Schedules whenever it sees appropriate.
(b) All fees are subject to taxation of the place where the arbitration is conducted.
(c) The Filing Fee is paid for the purpose of assessing if the filed Request for Arbitration or Submission to Arbitration meets the filing requirements of Lextar Arbitration Services. This fee is non-refundable even if the Request or Submission is found to not meet the filing requirements and is returned to the filing party. However, no new filing fee is required if the party filing the Request or Submission resubmits a corrected Request or Submission to Arbitration, which is found to meet the filing requirements and is accepted by Lextar Arbitration Services.
(d) The Commencement Fee is determined by reference to the amount of the claim and paid by the claimant on delivering the Notice of Request for, or Notice of Submission to, Arbitration.
(e) The Case Service Fee is paid by each party that:
i. delivers a Statement of Defense or Counterclaim, in which case the Case Service Fee is determined by reference to the total amount of the claim and counterclaim; or
ii. delivers only a Statement of Defense, in which case the Case Service Fee is determined by reference to the amount of the claim.
(f) Lextar does not charge fees for hearings, postponements, and other miscellaneous expenses.
(g) The Commencement Fee and the Case Service Fee are non-refundable once paid.
(h) Nonmonetary Claims: The non-monetary filing fee is the minimum filing fee for any case requesting non-monetary relief. Where a party seeks both monetary damages and non-monetary relief, the higher of the two filing fees shall apply.
(i) Fees for Additional Services: Lextar reserves the right to assess additional administrative fees for services it performs that go beyond those provided for in Lextar’s rules, but which are required as a result of the parties’ agreement or stipulation. Common examples include a request for transcribing arbitration hearings, a request for preservation of property, and a request for in-person hearing in a physical hearing room.
(j) Hearing Room Rentals: The fees described above do not cover the cost of hearing rooms, which are available on a rental basis. Check with Lextar for availability and rates.
(k) Incomplete or Deficient Filings: Where the applicable arbitration agreement does not reference Lextar, Lextar will attempt to obtain the agreement of all parties to have the arbitration administered by the Lextar.

(l) Arbitrations in Abeyance: Cases held in abeyance by mutual agreement for one year will be assessed an annual abeyance fee of $500, to be split equally among the parties. If a party refuses to pay the assessed fee, the other party or parties may pay the entire fee on behalf of all parties, otherwise the arbitration will be administratively closed. All filing requirements, including the payment of filing fees, must be met before a matter will be placed in abeyance.
